We retain account data for the duration of your account plus 90 days following account closure. Email event logs are retained for 90 days on the Growth plan and 365 days on Enterprise plans. You may request earlier deletion subject to legal retention requirements.

These Terms of Service ("Terms") govern your access to and use of CloudMailerHub Inc.'s services. By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or your organization. By using our Services, you represent and warrant that you meet these requirements.
You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. CloudMailerHub is not liable for losses resulting from unauthorized account use.
You agree to use our Services only for lawful purposes and in compliance with all applicable laws and our Acceptable Use Policy, which is incorporated by reference. Violations may result in immediate account suspension.
You agree to send email only to recipients who have explicitly opted in to receive communications from you. You are solely responsible for ensuring compliance with the CAN-SPAM Act, GDPR, CASL, and any other applicable anti-spam laws. CloudMailerHub reserves the right to suspend accounts with high bounce rates, complaint rates, or other indicators of non-compliant sending.
The following content is strictly prohibited on our platform: unsolicited commercial email (spam); phishing, fraudulent, or deceptive content; malware, viruses, or malicious code; illegal content under applicable law; content promoting violence or illegal activities; content violating third-party intellectual property rights.
Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law. Overages are billed at the end of each billing cycle. Failure to pay may result in service suspension.
CloudMailerHub provides uptime commitments of 99.9% for Starter, 99.95% for Growth, and 99.99% for Enterprise plans, measured monthly. Service credits may be issued for downtime below SLA thresholds as detailed in our SLA documentation.
CloudMailerHub retains all intellectual property rights in our platform, software, documentation, and trademarks. You retain ownership of your data and content transmitted through our Services.
To the maximum extent permitted by law, CloudMailerHub's aggregate liability shall not exceed the fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
You agree to indemnify and hold harmless CloudMailerHub from claims arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate this agreement upon 30 days' written notice. CloudMailerHub may terminate immediately for material breach of these Terms, including violations of our Acceptable Use Policy or Anti-Spam Policy.
These Terms are governed by the laws of the State of Texas, United States. Disputes shall be resolved in the courts located in Travis County, Texas, or through binding arbitration as agreed in writing.

CloudMailerHub reserves the right to update this AUP at any time. Continued use of our Services constitutes acceptance of the updated policy.
CloudMailerHub has a zero-tolerance policy toward spam in all its forms. We believe that unsolicited email harms recipients, degrades the email ecosystem, and undermines the trust that makes email a valuable communication channel. We take active, continuous steps to ensure our infrastructure is not used for spam.
For the purposes of this policy, "spam" means any email sent to recipients who have not provided explicit, verifiable, prior consent to receive that specific type of communication from that specific sender. This definition applies regardless of the commercial nature of the email.
CloudMailerHub requires all customers to send only to recipients who have explicitly opted in. We strongly recommend and, for marketing email, require double opt-in confirmation. Senders must be able to produce opt-in records including:

Every commercial email sent through CloudMailerHub must contain a clear, functioning unsubscribe mechanism. Unsubscribe requests must be honored within 10 business days as required by the US CAN-SPAM Act. Our platform automatically processes unsubscribes and adds opted-out addresses to suppression lists. Suppressed addresses cannot be sent to again through our platform.
CloudMailerHub participates in feedback loops (FBLs) with major ISPs including Gmail, Yahoo!, Outlook, and others. When a recipient marks an email as spam, we receive a complaint notification and automatically add that address to the sender's suppression list. Accounts with complaint rates above 0.1% receive warnings. Accounts above 0.25% are suspended pending compliance review.
We employ the following technical measures to prevent spam:
Account holders are responsible for all email sent through their account, including email sent by sub-users, API integrations, and third-party applications. The customer of record is liable for compliance regardless of which downstream system initiated the send.
Violations of this Anti-Spam Policy result in immediate suspension. CloudMailerHub cooperates fully with the FTC, FCC, ISPs, M3AAWG, and other relevant organizations to combat spam. We report confirmed spammers to appropriate authorities and blocklist operators.

CloudMailerHub's infrastructure is hosted in the United States. For transfers of EU personal data to the US, we rely on Standard Contractual Clauses (SCCs) as approved by the European Commission. These are incorporated into our DPA.
CloudMailerHub uses a limited number of sub-processors to deliver our Services. All sub-processors are bound by confidentiality and data protection obligations at least as protective as those in our DPA. A current list of sub-processors is available upon request.
In the event of a personal data breach affecting your data, CloudMailerHub will notify you without undue delay and within 72 hours of becoming aware of the breach, as required by GDPR Article 33. Our notification will include the nature of the breach, data categories affected, approximate number of individuals affected, and remediation steps taken.

We require all customers sending commercial email through our platform to comply with CAN-SPAM requirements as a condition of service.

All email sent through our platform must contain accurate "From," "To," "Reply-To," and routing information. Falsified or misleading header data is prohibited and may result in immediate account suspension.
Subject lines must accurately reflect the content of the email. Deceptive subject lines designed to trick recipients into opening messages are prohibited.
Commercial emails must be clearly identified as advertisements if the recipient has not given prior affirmative consent to receive the message.
Every commercial email sent through CloudMailerHub must include a valid physical postal address of the sender. This may be a current street address, a Post Office Box registered with the USPS, or a private mailbox registered with a commercial mail receiving agency.
Every commercial email must include a clear and conspicuous explanation of how the recipient can opt out of receiving future commercial email from the sender. The opt-out mechanism must:
CloudMailerHub automatically processes unsubscribe requests and adds opted-out addresses to suppression lists within seconds. Customers must not send commercial email to any address that has opted out within 10 business days. Our platform prevents sending to suppressed addresses at the infrastructure level.
CloudMailerHub's own marketing and transactional communications comply fully with CAN-SPAM. We only send commercial email to individuals who have provided consent, and we honor all unsubscribe requests promptly.
Customers found to be violating CAN-SPAM requirements face immediate account suspension. CloudMailerHub cooperates with FTC investigations and may report confirmed violations. Customers indemnify CloudMailerHub for any penalties arising from their own CAN-SPAM violations.
